Obtaining a K-bis before a commercial receipt for Algerian nationals:
According to the Franco-Algerian agreements of 1968, it is possible for an Algerian national who wishes to exercise a non-salaried activity to request a K-bis extract by presenting his passport or even his national identity card.
The Trade and Companies Register Coordination Committee (CCRCS) confirmed this in opinion no. 2014-22, which states that:
The movement, stay and work of Algerian nationals in France are governed in full by the Franco-Algerian agreement of December 27, 1968, as amended.
Article 5: Algerian nationals settling in France to exercise a professional activity other than salaried employment receive, after the usual medical check-up and upon proof, as the case may be, that they are registered in the trade register or the trades register or with a professional body, a certificate of residence under the conditions set out in Articles 7 and 7 bis.
Registration with the RCS is therefore a prerequisite for the issuance of a residence permit.
The clerk will register the application if it is complete and compliant. If not, the clerk will request the missing information or documents. In the event of a dispute, the declarant may refer the matter to the judge responsible for monitoring the registry.
It is the declarant or his duly authorized representative who may contest the claim for missing information or documents notified to him by the clerk.

Important: the K-bis application must be made with a valid Algerian passport and not with a student residence permit.
